None of the established gun control groups support this measure.

None of the Democratic Party leadership supports this measure.

Will criminals turn in their guns? No.

Overview of San Francisco Proposition H:
  • Prohibits sale, distribution, transfer, manufacture of all firearms and ammunition within San Francisco.
  • Prohibit San Francisco residents from possessing handgun, except for on duty law enforcement (city, state, federal), armed forces and security guards. Must surrender ALL handguns or remove from the City within 90 days.
  • Penalty for violation not established.
This proposition is flawed:
  • Effectively denies you the right to defend yourself, your family and your business. Worse yet, merely showing a handgun to stop a criminal attack could result in being prosecuted and getting sued by the criminal.
  • Violates state preemption law which says that San Francisco cannot pass laws contrary to State laws (this is why the 1982 attempt by Mayor Feinstein was overturned. The City will waste your money in an expensive court battle.
  • Pig-in-a-poke! There is no penalty established by Prop H. Board of Supervisors must decide. Will this be a hand slap? Prison? Violation of your privacy including search of your home?
  • No exemption for off duty and retired law enforcement. No exemption for judges and DAs. Puts them in danger of retribution hits by criminals, forcing them to leave the City.
  • Encourages home invasions by removing the threat of finding an armed resident. Encourages more crime in general. Just as San Francisco has become a magnet for drugs and prostitution, it will become a magnet for violent criminals.
  • Does nothing to disarm criminals (it is already a felony for a criminal to possess a gun).
  • Denies the elderly, the physically challenged, and many women the ability to defend themselves as only bulky, heavy and hard to operate rifles and shotguns will be legal. In addition, using a rifle for self-defense in a crowded urban area is dangerous.
  • Provides no compensation for the value of confiscated guns. Invites lawsuits which will probably win. If only 10% of SF households own handguns, and the average value is only $500, San Francisco would owe over 16 million dollars in compensation.
  • Businesses may leave the City, especially in the diamond, jewelry and fine collectibles as they will increasingly be targeted by everything from international criminal rings to neighborhood thugs. Small neighborhood shops may shutter at night, or simply leave dangerous neighborhoods.
  • Will result in lost jobs and tax revenue. Private security guards required to take their pistol home at night must move out of the City. Tax revenue generated by the antique arms and armor sales of auction house Bonham & Butterfield will be lost, along with jobs.
Points to ponder:
  • Opposed by San Francisco Police, both active and retired.
  • Numerous state and federal court rulings and state law (CA Govt. Code Sec. 845) establish that the San Francisco Police Department has no duty to provide personal protection to any individual - only to society at large.
  • Washington, D.C. has a handgun ban, and is arguably the murder capitol of the USA. Murder is higher now than before the ban.
  • England banned firearms, and crime increased (up to 28% for street robberies; rape and murder have both increased).
  • In Australia, crime increased over 100% in all violent categories after handguns were banned.
  • Nobody is encouraged to possess a firearm, but don't you, your family and your friends deserve the right to make that choice?
  • Democrats who support this measure are following its proponents off a cliff. Its passage here will strengthen the NRA and make it harder for Democrats to get elected nationwide.
